What do I do first?
Check your documents, but Tesla usually requires that you send a demand to resolutions@tesla.com. Make sure to include your name, VIN number and a specific description of what you think you should be paid and why. Most Tesla agreements require that you wait 60 days for Tesla’s response before taking the next step.
How do I initiate arbitration with Tesla?
You must submit a request through a an arbitration organization specified in the agreement. This is usually American Arbitration Association following the AAA’s rules and the provisions of Tesla’s contract.

Do I need a lawyer?
That is entirely your choice. In my case, I was both the lawyer and the client. There’s an old saying that a lawyer who represents themself has a fool for a client. In my case, it worked out fine. In all likelihood, Tesla will have a lawyer, whether it’s outside counsel or in-house counsel. In my case, Tesla had two lawyers attend the hearing, but only the outside counsel spoke.
How do I know if I won?
After the arbitrator hears all of the testimony, reviews the evidence and considers the arguments of the parties, they issue an “award.” The award might give brief or extensive reasons for why the arbitrator ruled the way they did. If the arbitrator ruled in your favor, Tesla may pay the amount of the award without question. A party receiving an award has the statutory right to have a court vacate (overrule), modify or confirm the award. The grounds for a court acting to change the award are very limited and the instances of this occurring are rare. If the court confirms the award, then it becomes a judgment. In most cases, once the court rules, the losing party, if they owe money, will then pay the award.
